Terms and Conditions
1. Agreeing to these terms
These Terms and Conditions ("Terms") govern your access to and use of AshMoneyMentor.com, its calculators, forms, downloadable reports and other content, and my business pages and posts on social media and other platforms (together, the "Services"). By using the Services you agree to these Terms and to my Privacy Policy and Disclosures, which form part of them. If you do not agree, please do not use the Services.
If you become a client, the agreements, disclosures and product documents for that engagement are separate. If they conflict with these Terms, those documents prevail for that engagement.
2. Who operates this website
The Services are operated by Ash Money Mentor ("I", "me", "my"), an operating name of a licensed financial professional in Ontario, at Unit 211 - 111 Brunel Rd, Mississauga, ON L4Z 3E9. Licence details and my relationships with insurers are set out in my Disclosures.
3. Education only; no advice; no client relationship
- All content in the Services is general information for educational purposes. It is not, and must not be treated as, personal financial, insurance, investment, tax, legal or accounting advice, or as a recommendation, offer or solicitation to buy or sell any product.
- Content is general and does not consider your goals, finances, health or risk tolerance. It may be incomplete or out of date. Do not take it at face value. Please consult a licensed financial professional, an accountant or tax professional, and a lawyer about your own situation before making decisions.
- Using the Services, submitting a form, downloading a report, attending a free presentation, following me on social media, or exchanging messages does not create a client, fiduciary or professional relationship. Any such relationship begins only when we agree to it in writing for a specific engagement and I have given you the required disclosures.
- You are responsible for your own decisions and for checking information with the original sources before relying on it.
4. Who may use the website
You must be at least 18 years old and able to enter a binding agreement to use the Services. The Services are intended for people in Ontario, Canada. I may offer products only where I am licensed, and some products may not be available to you. Nothing in the Services is an offer to anyone in a place where it would be unlawful.
5. Calculators and reports
- Calculators, charts and reports are illustrations based on the numbers and assumptions you enter and the standard formulas used. They are not forecasts, projections of any real product, or promises.
- Real investments rise and fall, and results may be much lower than shown. Calculators generally ignore fees, taxes, inflation (unless shown), contribution limits, and changes in rules or your circumstances.
- Savings rates shown for comparison are approximate and are as of the date displayed. They come from public sources, change often, and are not an offer by any financial institution.
- I try to make the tools accurate but do not promise they are error-free. Please check results independently and do not rely on them as your only basis for a decision.
- A downloadable report reflects only the information you entered on the date you created it.
6. Insurance and investment products
- Insurance products and segregated fund contracts are contracts between you and the insurance company. The insurer decides whether to accept your application. Coverage and benefits are subject to the policy or contract, including its definitions, exclusions, limits, waiting periods and conditions. If anything on the Services differs from the policy or contract, the policy or contract applies.
- Descriptions of products on the Services are summaries only. Before you buy, read the insurer's documents, including the contract, information folder and fund facts where applicable.
- I do not guarantee that you will qualify for, or be offered, any product, price or benefit.
- I am licensed for insurance only and do not sell mutual funds, stocks, bonds, exchange-traded funds or other securities.
7. Consultations, presentations and fees
- The initial consultation and the free financial review and presentation are provided at no cost and with no obligation to buy anything.
- I do not charge you for using the Services. I am usually paid commissions by insurers if you buy an insurance product through me, as explained in my Disclosures. There are no hidden charges from me. Any fee that you would pay me directly will be explained and agreed with you in writing in advance.
- Costs inside a product, such as premiums and withdrawal or surrender charges, are set by the insurer and shown in its documents.
- I may need to reschedule or cancel appointments. I am not responsible for costs you incur in connection with a consultation, such as travel or time off work.
- No gifts, rebates or other inducements are offered for buying insurance.
8. Your information and communications
- Information you give me must be true, accurate and complete, and you must have the right to share it. Inaccurate information in an insurance application can lead to denial of a claim or cancellation of a policy.
- By sending me a form or message you agree that I may contact you about your request using the contact details you give, in line with the choices you make on the form and Canada's anti-spam law. You can opt out at any time.
- Do not send sensitive information such as Social Insurance Numbers, banking or card details, passwords or medical details through the Services, social media, text or ordinary email. I will not act on instructions to buy or sell products, change account details or move money received by email, text or social media, and I am not responsible for loss arising from information sent that way.
9. Acceptable use and security
You agree not to:
- use the Services unlawfully, or to harass, defame or mislead anyone, or to impersonate me or anyone else;
- copy, scrape, harvest, mirror or republish the Services or their content by automated or other means without my written permission;
- interfere with or try to gain unauthorized access to the Services, servers, networks or other users' data, introduce viruses or harmful code, or overload the Services;
- submit false enquiries, spam, or the personal information of someone else without their consent; or
- use the Services to compete with me, or to market products or services to others.
The internet is not risk-free. You are responsible for the security of your own devices and for scanning anything you download. To the extent the law allows, I am not responsible for damage caused by viruses or harmful code that you may encounter through the Services.
10. Intellectual property
The text, calculators, charts, reports, graphics, logos, designs, software and other content in the Services, and the names "Ash Money Mentor" and "AshMoneyMentor.com", belong to me or are used with permission and are protected by Canadian and international law. I grant you a limited, personal, non-exclusive, non-transferable, revocable licence to view the Services and to print or save a copy of the content and your own reports for your personal, non-commercial use, keeping all notices intact. Any other use needs my written permission. Rights not expressly granted are reserved.
11. Your comments and feedback
If you send comments, ideas or feedback, you give me permission to use them to run and improve my business without payment or credit to you, but I will not publish your name or personal details or present your comment as a testimonial without your separate written permission. Do not submit anything that is unlawful, infringes someone's rights, or that you do not have the right to share.
12. Third-party links and content
The Services link to government and other third-party websites and to social media platforms for your convenience. I do not own, control or endorse them, and I am not responsible for their content, accuracy, availability, security or privacy practices. You use them at your own risk and under their terms. Opinions or statements posted by other people are theirs alone.
13. Disclaimer of warranties
To the fullest extent permitted by law, the Services and all content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of accuracy, completeness, timeliness, fitness for a particular purpose or non-infringement. I do not promise that the Services will be uninterrupted, secure or error-free, that defects will be corrected, or that any result will be achieved. Content may contain technical or typographical errors and may be changed at any time.
14. Limitation of liability
To the fullest extent permitted by law, I will not be liable to you for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, savings, opportunity, data or goodwill, arising from your use of, or inability to use, the Services or from your reliance on any calculator, report, article, post or other content, even if I have been told such losses are possible. To the same extent, my total liability to you for any claim connected to the Services (as opposed to a specific insurance engagement, which is covered by its own documents and by law) will not exceed the greater of the amount you paid me for the Services (which is normally nothing) and one hundred Canadian dollars (CAD $100).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or wilful misconduct, and nothing limits any rights you have under Ontario consumer protection or insurance laws. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
15. Your responsibility
You agree to be responsible for your use of the Services and for any decision you make using them. To the extent permitted by law, you agree to compensate me for losses, claims and reasonable legal costs that result from your unlawful use of the Services, your breach of these Terms, or your infringement of someone else's rights.
16. Privacy
My Privacy Policy explains how I handle personal information and your rights. It is part of these Terms.
17. Governing law and resolving disputes
- Law. These Terms and any dispute about the Services are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules.
- Talk to me first. If you have a concern, please send me written notice describing it and what you would like done, using the contact details in section 20. I will respond in good faith and we will try to resolve it informally within 30 days. If it concerns my conduct as a licensed financial professional, my Disclosures explain how to complain, including to the OmbudService for Life & Health Insurance and the Financial Services Regulatory Authority of Ontario.
- Mediation. If we cannot settle the matter, either of us may propose mediation with a neutral mediator in Ontario before starting court proceedings. The costs of the mediator are shared equally unless we agree otherwise. Mediation is optional and does not stop either of us from going to court to protect urgent rights.
- Courts. Subject to the above, and subject to any rights you have under law to bring a claim elsewhere, the courts of Ontario have jurisdiction over disputes about the Services.
- Product disputes. A dispute about an insurance policy, claim or underwriting decision is governed by that policy, the insurer's complaint process, and the law, not by this section.
- Your legal rights. Nothing in these Terms takes away rights you have under Ontario consumer protection, privacy or insurance laws, or your right to complain to a regulator or ombudservice.
18. Changes, suspension and termination
I may change the Services or these Terms at any time by posting the updated version with a new date at the top. Changes apply from the date posted, and continuing to use the Services means you accept them. I may suspend or end your access at any time if I believe you have broken these Terms or the law, or to protect the Services or others. Sections that by their nature should continue, including those on intellectual property, disclaimers, limits of liability and governing law, will continue after your access ends.
19. General
- Severability. If any part of these Terms is found invalid or unenforceable, that part is limited or removed to the minimum extent needed and the rest stays in effect.
- No waiver. If I do not enforce a right right away, I have not given it up.
- Entire agreement. These Terms, the Privacy Policy and the Disclosures are the whole agreement about your use of the Services and replace earlier understandings about it.
- Assignment. You may not transfer your rights under these Terms. I may transfer mine in connection with a sale or reorganization of my business.
- Events beyond my control. I am not responsible for delay or failure caused by events outside my reasonable control, such as outages, power or internet failures, cyber attacks, supplier failures, or natural events.
- Electronic communication. You agree that I may give you notices by posting them on the Services or by email to the address you gave me.
- Language. The parties have asked that these Terms be written in English. Les parties ont exigé que ces conditions soient rédigées en anglais.
